The Digital Asset Tax Certainty Act proposes a reporting exemption for small cryptocurrency transaction fees starting in 2028. House lawmakers scheduled a Wednesday markup of the 114 page bill in the Ways and Means Committee. This gain or loss exception applies to transactions under $10 for users who made 5,000 or fewer transfers in the prior year and covers specific network fees paid in digital assets.
The legislation incorporates rules for stablecoins, lending, and wash sales, alongside simplified accounting for widely traded assets. Staking rewards remain taxable as ordinary income, as the draft omits tax deferrals for mining and staking rewards previously discussed by Republicans. The bill advances to the House floor for a full vote if it receives committee approval on Wednesday.
