House Ways and Means Approves First Crypto Tax Framework in 38-5 Vote

The Digital Asset Tax Certainty Act moves toward a full House vote after winning approval from a key legislative committee on Sept. 16. This legislative package, designated H.R. 10357, removes reporting requirements for crypto network fees of $10 or less for users who made 5,000 or fewer transfers in the previous year. It applies existing wash-sale rules to digital assets and specifies the tax treatment for $1 stablecoins and qualified digital asset loans.

Chair Rep. Jason Smith called the 38-5 vote a historic moment resulting from over a year of bipartisan collaboration. The framework aims to provide statutory certainty for entrepreneurs and creates a tax structure intended to encourage crypto foundations to operate within the U.S. market. The bill's passage follows a period of negotiation regarding the taxation of mining and staking rewards.
