Kirsten Gillibrand, Mark Warner and five other Senate Democrats who voted against advancing the CLARITY Act on Tuesday pledged to keep working with Republicans to pass the crypto market structure bill. “This week was a setback, but not the end of that important work,” the senators said in a statement. Early efforts are underway to restart bipartisan talks and gauge support for passage before the end of the year, Eleanor Terrett reported, citing three people familiar with the discussions.

The procedural motion failed with 49 votes in favor and 50 against, short of the 60 needed to advance. Democrats withheld support over ethics provisions addressing President Donald Trump’s crypto interests. The other senators signing the statement were Angela Alsobrooks, Cory Booker, Catherine Cortez Masto, Ruben Gallego and Raphael Warnock. The bill would establish a federal framework for digital assets and clarify the roles of the SEC and CFTC.

Republican Senator Thom Tillis switched his vote to no and filed a motion to reconsider, preserving a procedural route to another vote. House Majority Whip Tom Emmer told Fox Business the defeat “doesn't spell doom” but “just delays it until after the midterms.” After Tuesday’s vote, Polymarket put the chance of the bill becoming law by year end at 7%.
