The Securities and Exchange Commission and the Commodity Futures Trading Commission will lead the effort to create new guidelines for the digital asset industry. White House crypto adviser Patrick Witt told a Georgetown University conference that the Trump administration is forging ahead with executive policies after the Senate failed to pass the Clarity Act last week. The administration intends to provide as much regulatory certainty as possible for the sector through these policies rather than waiting for legislative approval.
The transition to agency-led regulation prioritizes tokenization and maintains the schedule for GENIUS stablecoin rulemaking. Treasury official Luke Pettit and Witt cautioned that rules enacted via agency authority are less durable and more susceptible to legal challenges than formal federal legislation. This shift in strategy follows a failed cloture vote in the Senate, prompting the executive branch to utilize existing authorities to establish market structure.
