A federal judge previously halted the rapid removal of migrants based on the ruling that the process violated due process rights. The Trump administration is now asking the Supreme Court to overturn that decision and immediately revive a policy that allows the government to deport migrants to nations where they do not hold citizenship as part of a larger mass deportation agenda.
The emergency petition seeks to resume these operations without several protections ordered by lower courts, including the requirement to provide more than 24 hours notice to deportees. The administration is also challenging the mandate that migrants be allowed to file fear-based challenges before being removed to a third country.
