A 28 year old man was moved from a Texas hospital to a federal detention facility after being wounded by a law enforcement officer on September 20. Lawyer Kate Lincoln-Goldfinch alleges that Wilber Garcés Pérez was transferred to an ICE processing center only 4 hours after the incident with a bullet still lodged in his spine, where he spent the night without a bed or pain medication.

The Department of Homeland Security identifies Pérez as an illegal migrant with a final order of removal. His lawyer claims he entered the U.S. in 2024 via the CBP One program with a valid work permit but missed a hearing after the notice was sent to an old address. Homeland Security Investigations is leading the probe into the shooting, which Rep. Greg Casar has condemned as an unacceptable outcome of an ICE surge in Austin.
