US District Judge Timothy Kelly declined to immediately restore White House access for CNN, MS NOW and Politico on Wednesday, despite telling attorneys that the administration had not given their reporters appropriate due process. Kelly ended the hearing without a ruling from the bench, taking the matter under consideration.

The outlets sued President Donald Trump and his administration on Monday to restore their credentials, arguing that the ban violated their First Amendment rights. Previous court decisions require notice and an opportunity to appeal before journalists lose White House access. That process “wasn’t played out here,” Kelly said. The Justice Department argued in a Tuesday night filing that “access to the White House is a privilege, not a right” and that the outlets’ reporting could threaten national security.

The dispute has also disrupted shared television coverage of the president. ABC, CBS, NBC and Fox declined to replace CNN after the White House blocked it from its assigned pool duties Monday, suspending coverage of events designated for the TV pool. The five networks normally rotate assignments and share footage with other outlets. On Wednesday, the White House Correspondents’ Association joined the Reporters Committee for Freedom of the Press and nearly 50 news organizations in a court brief urging immediate restoration of the outlets’ access.
