This latest ad follows a previous federal expenditure of at least $443,000 on a commercial that aired on Fox News in major markets 38 days before the midterms. The Senate is probing those expenditures to determine if they violated the federal prohibition on using public money for "publicity or propaganda." The White House has defended the videos as nonpartisan public service announcements, stating that "patriotism isn’t partisan."
