1 House Committee Advances First Digital Asset Tax Framework in 38-5 Vote 🪙 Crypto Sep 16, 5:03 PM EDT 30/17
A $10 exemption for small network and transaction fees starting in 2028 is the centerpiece of the Digital Asset Tax Certainty Act advanced by US lawmakers on Sept. 16. The House Ways and Means Committee voted 38-5 to move the bill forward, extending wash-sale and constructive-sale rules to digital assets to limit the use of losses to lower tax liabilities. The legislation also establishes new reporting requirements for dollar stablecoins and mining.
The 114 page package excludes tax deferrals for mining and staking rewards, which remain ordinary income, and bars the transaction fee exemption for users with more than 5,000 transfers in the prior year. Committee Chair Jason Smith cited a year of bipartisan work to establish the first tax framework for digital assets. The bill proceeds to a full House vote.
