The Federal Bureau of Investigation is assisting Homeland Security Investigations in a probe into a September 20 officer involved shooting in Texas. Wilber Rafael Garces Perez, a Venezuelan national, was shot during a law enforcement operation in Austin and is currently in federal custody pending removal. Perez was transferred to ICE custody from Dell Seton Medical Center after being treated for torso injuries.

The Department of Homeland Security stated that Perez entered the U.S. illegally under the Biden administration and held a final order of removal. Attorney Kate Lincoln-Goldfinch disputes this account, asserting that Perez previously held a valid work permit and entered the country lawfully. The incident sparked protests in North Austin, where Texas Department of Public Safety troopers deployed pepper balls and made multiple arrests to disperse the crowd.
