Federal Judge Timothy Kelly ordered the Trump administration to immediately restore White House press credentials for CNN, MS NOW and Politico, finding they were likely revoked in violation of Fifth Amendment due process protections. The 14 day temporary restraining order blocks the ban while the outlets challenge it in court. Kelly, a Trump appointee, wrote that the outlets “did not receive notice and an opportunity to be heard” before their passes were revoked.

The outlets sued Monday after President Donald Trump banned them over coverage he branded “fake news” and “fiction and lies.” The Justice Department defended the restrictions on national security grounds, arguing that “access to the White House is a privilege, not a right.” Kelly rejected that justification at this stage, finding little factual support that revoking the credentials would protect national security.

ABC, CBS, NBC and Fox had declined to replace CNN’s assigned White House TV pool crew on Monday, suspending pooled presidential coverage. The five networks rotate assignments and share footage with other outlets. Whether that coverage will resume remained unclear: the White House had not said whether CNN could return to the pool, a separate issue from restoring credentials, correspondent Weijia Jiang reported.
