Federal Judge Timothy Kelly issued a 14 day temporary restraining order requiring the Trump administration to immediately restore White House press passes for CNN, MS NOW and Politico, finding their revocation likely violated Fifth Amendment due process protections. Kelly, a Trump appointee, said the outlets “did not receive notice and an opportunity to be heard” before their credentials were revoked.

President Donald Trump announced the ban on Sept. 18, accusing the outlets of publishing “FICTION and LIES.” They sued on Monday, alleging violations of their First Amendment rights and due process. The Justice Department defended the restrictions on national security grounds, but Kelly found little factual support at this stage that revoking the credentials would protect national security. He also handled the 2018 case that restored CNN reporter Jim Acosta’s press pass.

The ban had disrupted shared television coverage of the president. ABC, CBS, Fox News and NBC declined to replace CNN’s assigned White House pool crew on Monday, suspending the rotating coverage that supplies footage to other news organizations. The White House Correspondents’ Association, the Reporters Committee for Freedom of the Press and nearly 50 news organizations backed the outlets in court, arguing that the government cannot exclude journalists because it dislikes their reporting.
