The Justice Department asked a federal judge late Friday to reject CNN, MS NOW and Politico’s request for a preliminary injunction, which would preserve their journalists’ White House access while they challenge President Donald Trump’s ban. The filing seeks to let Trump reinstate the restrictions after a temporary court order expires.
US District Judge Timothy Kelly scheduled arguments for 11 a.m. ET on Oct. 8, the final day of his 14 day restraining order. Kelly restored the outlets’ press credentials on Sept. 24, finding they were likely to succeed on their claim that the administration revoked them without constitutionally adequate due process. In seeking longer protection, the outlets warned that the White House would “immediately reinstate a complete ban” if given the opportunity.
The administration previously argued that the outlets’ reporting threatened national security, a justification Kelly found had little factual support at that stage. The Washington Post reported that one Politico article criticized by the White House was based on an administration press call whose participants were instructed to attribute remarks to an anonymous “senior administration official.” The access dispute has continued despite Kelly’s order, including CNN’s exclusion from pool duties for Trump’s Thursday trip to Texas and Oklahoma.
